The practice of members of the FBTs, operating under the so called Hoy system, of black listing Exhibitors through simultaneously cancelling the service of any Exhibitors against whom an adverse decision has been rendered by the Joint Arbitration Board of the Exhibitors and Exchange Managers, is clearly illegal and in restraint of trade. We realize that there are occasions when it becomes necessary to take some drastic action against either an Exhibitor or Exchange Manager who deliberately violates a contract or the rules of good business. We believe, however, that such occurrences can be remedied in a legal manner by the proper cooperation between the Distributors and the MPTOA through the proposed arbitration machinery.
